iTrader.im Private Seller Terms

1. About these Terms

These Private Seller Terms apply when an individual uses iTrader.im to advertise a vehicle for private sale. iTrader.im is a trading name of Code Lab Platforms Limited, company number 139244C.

Before submitting a new Listing, resubmitting a rejected or removed Listing, or submitting changes to a live Listing for moderation, you must expressly accept the current version of these Terms, the Acceptable Use Policy and Refund Policy using the acceptance control presented by the Platform. Creating an account or merely continuing to use the Platform is not treated as that acceptance.

2. Eligibility

2.1 The account holder must be 18 or over.

2.2 A person under 18 must not independently create an account or enter into an advertising contract with iTrader.

2.3 A vehicle owned by a person under 18 may be advertised through an adult's account where the adult has the owner's permission and accepts responsibility for the Listing and compliance with these Terms. The adult is the contractual customer of iTrader.

3. Private advertising

3.1 A standard private Listing is charged at the price displayed at checkout, including any launch offer then available, and remains available for up to 60 days.

3.2 Each vehicle requires its own Listing. Multiple Listings are permitted and encouraged where a seller has multiple vehicles.

3.3 A seller may renew after the 60-day period.

3.4 Featured status may be purchased at the additional price displayed at checkout. Where checkout offers an optional support payment, that payment is the amount displayed there and is not required in order to advertise.

4. Editing Listings

Sellers may edit Listings where permitted. A change is checked before it replaces the public advert. Until that check is complete, the Listing stays live with its last approved details. iTrader may unpublish the Listing during review. Editing does not reset the 60-day period unless expressly stated.

5. Marking a vehicle as sold

5.1 Sellers must mark a vehicle as sold promptly once it is no longer available.

5.2 Marking a Listing as sold does not terminate the paid advertising period. The Listing may remain online for the remainder of the period originally paid for.

5.3 Selling early does not, by itself, create an entitlement to a refund.

6. Seller declarations

By completing the seller declaration and submitting a Listing, you confirm that:

you own the vehicle or have the owner's permission to advertise it;

the information supplied is accurate and material facts are not deliberately concealed;

the mileage is accurate to the best of your knowledge;

you have authority to use uploaded photographs and other content;

the vehicle is not stolen or a prohibited written-off vehicle;

any Category N or Category S status is clearly disclosed; and

the Listing complies with the Acceptable Use Policy.

7. Prohibited vehicles and Listings

You must not advertise written-off or stolen vehicles, vehicles without authority, multiple vehicles within one Listing, number plates, vehicle parts unless expressly permitted in future, fictitious vehicles, false mileage, materially misleading descriptions, or misleading photographs. Category N and Category S vehicles are permitted only where their status is clearly stated in the description.

8. Photographs and content

Photographs must relate to the advertised vehicle, must not materially mislead, and must be used with appropriate rights or permission. Nudity, sexually explicit material and other unsuitable content are prohibited. iTrader may remove unsuitable photographs or Listings.

9. Private seller status

A Private Seller account may only be used by a genuine private seller. It must not be used to disguise commercial vehicle trading. If iTrader reasonably believes you are acting commercially, it may require an appropriate Dealer account.

10. Relationship with buyers

10.1 iTrader is an advertising marketplace and does not sell vehicles. It is not the seller, buyer, broker or agent.

10.2 Any contract for sale is solely between buyer and seller. iTrader does not guarantee condition, ownership, legality, mileage, history, roadworthiness, availability or description.

10.3 Buyers and sellers are responsible for carrying out their own checks before entering a transaction.

11. Buyer enquiries

Buyers may browse Listings without an account. Sending a message through Contact Seller requires the buyer to sign in. Sellers are responsible for responding. iTrader does not guarantee that enquiries are genuine or will result in a completed purchase.

12. Disputes Between Buyers and Sellers

12.1 Any contract for the sale of a vehicle advertised on iTrader.im is solely between the buyer and seller. iTrader.im is not a party to that transaction and is not responsible for resolving disputes between buyers and sellers.

12.2 Buyers and sellers are responsible for resolving disputes directly with each other, including disputes relating to the vehicle's condition, history, ownership, price, payment, delivery, representations or any other aspect of the transaction.

12.3 While iTrader.im does not provide a formal dispute-resolution, mediation or arbitration service, iTrader.im may, at its discretion, provide limited assistance where it considers this appropriate. This may include:

assisting with communication between the parties;

contacting a buyer or seller regarding a reported issue;

requesting further information or evidence relating to a Listing;

investigating potentially fraudulent, misleading or prohibited Listings; or

taking appropriate action against a Listing or account where a breach of iTrader.im's Terms or Acceptable Use Policy is identified.

12.4 Any assistance provided by iTrader.im is discretionary and does not make iTrader.im responsible for the underlying dispute or transaction. iTrader.im does not guarantee that any investigation or assistance will result in a particular outcome.

12.5 iTrader.im may decline to become involved where it considers that the matter is primarily a private contractual dispute or where involvement would be inappropriate or disproportionate.

12.6 Where iTrader.im identifies evidence of fraud, unlawful activity or a serious breach of its Terms, it may remove or suspend a Listing or account and, where appropriate, report the matter to relevant authorities.

13. Moderation, fraud and account action

13.1 iTrader may review Listings before or after publication and may reject, suspend, edit, unpublish or remove them at its discretion.

13.2 iTrader may suspend or terminate accounts where appropriate, including for breach, suspected fraud, unlawful activity or misleading Listings.

13.3 Where a Listing or account is removed because of breach, no refund will normally be provided.

13.4 iTrader may retain information concerning suspicious activity where reasonably necessary for security, fraud prevention, legal compliance or investigation.

14. Fees and refunds

Private Listing and Featured fees are the prices displayed at checkout, including any launch offer then available. A standard private Listing runs for 60 days. Refunds are governed by the iTrader.im Refund Policy. Nothing in these Terms excludes statutory rights that cannot lawfully be excluded.

15. Intellectual property and privacy

15.1 You retain ownership of content you upload, but grant iTrader a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format and distribute it as reasonably necessary to operate, market and promote iTrader.

15.2 You confirm you have the necessary rights to grant this licence.

15.3 Personal information is handled in accordance with iTrader's Privacy Policy and applicable data protection law.

16. Limitation of liability

16.1 Nothing excludes or limits liability that cannot lawfully be excluded.

16.2 iTrader is not responsible for the conduct, representations, omissions or actions of buyers or sellers, or for disputes concerning a vehicle or transaction.

16.3 iTrader does not guarantee continuous or error-free availability of the Platform.

17. Account termination and changes

You may cease using your account at any time. iTrader may suspend or terminate an account for breach, suspected fraud or unlawful activity, misleading Listings, or where reasonably necessary to protect users or the Platform. iTrader may update these Terms from time to time, subject to applicable law.

18. Governing law

These Terms are governed by the laws of the Isle of Man. Subject to mandatory legal rights, the courts of the Isle of Man shall have jurisdiction over disputes arising from these Terms.
